Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Lusson LLC (“Mealbird,” “we,” “us”) covering the mealbird.app website, the Mealbird waitlist, and the Mealbird iOS app when it becomes available (together, the “Service”). By using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.

1. The Service

Mealbird plans a week of meals to your protein and calorie targets, computes the macros from public nutrition data, and produces a shopping list. The Service is the mealbird.app website, the email waitlist, and the Mealbird iOS app. Grocery prices and store aisles are based on United States data. We may add, change, or discontinue features at any time.

2. Eligibility

You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live. The Service is not directed to children under 13, and we do not knowingly collect their information.

3. The waitlist

If you give us your email address to join the waitlist, we’ll use it to send you one notice when Mealbird reaches the App Store, plus the occasional related update. You can unsubscribe at any time using the link in any email or by writing to info@mealbird.app. See our Privacy Policy for how we handle your data.

4. Subscriptions and billing

Mealbird is a subscription. There are two plans: $29.95 per year, which begins with a 3-day free trial, and $9.95 per month, which has no trial. Cancel during the free trial and you are not charged. Prices may change; any change will be disclosed before it applies to you.

Building a meal plan requires an active subscription. Everything before that — the questions, the targets we calculate for you, and the example week — costs nothing.

Purchases made through the Apple App Store are processed and billed by Apple, and are also subject to Apple’s terms. Your subscription renews automatically until cancelled. You manage or cancel it in your Apple ID settings — deleting the app does not cancel a subscription. Except where the law or the App Store requires otherwise, payments are non-refundable.

5. Nutrition and health disclaimer

Mealbird is a planning and informational tool, not medical, nutritional, or professional health advice, and it does not diagnose, treat, or prevent any condition. Calorie and macro targets are general estimates. Talk to a qualified professional before making significant changes to your diet, especially if you are pregnant or nursing, are managing a medical condition, or have a history of disordered eating. You are responsible for checking ingredients against your own allergies and dietary needs.

6. Nutrition data and prices

Macro figures are computed from the U.S. Department of Agriculture’s FoodData Central, a public-domain data source, and are checked with arithmetic rather than generated by AI. Even so, nutrition data can contain errors and real foods vary, so we do not guarantee exactness. Grocery prices shown in the Service are disclosed estimates based on average U.S. prices and refreshed periodically — they are not live prices from any store, and what you actually pay will differ.

7. Acceptable use

You agree not to:

• break the law or infringe anyone’s rights while using the Service;
• copy, scrape, resell, or redistribute the Service or its content except as these Terms allow;
• interfere with, probe, or try to gain unauthorized access to the Service or its infrastructure;
• submit anyone else’s email address to the waitlist without their permission.

8. Intellectual property

The Service — including the Mealbird name, the bird mascot, the software, design, and copy — is owned by Lusson LLC and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the Service for your own, non-commercial meal planning. Underlying USDA data is public domain and not covered by this restriction.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that it will meet a particular nutrition or weight goal.

10. Limitation of liability

To the fullest extent permitted by law, Lusson LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $50. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above, and material changes will be highlighted where appropriate. Continuing to use the Service after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute that isn’t subject to Apple’s terms.
